EU Recycled Plastic for Food Contact: Technology, Process and Use Are Separate Checks

Regulation 2022/1616 distinguishes recycling technologies, processes and installations. Recycled-content evidence alone does not establish food-contact suitability.

A percentage of recycled plastic describes a material input. It does not, by itself, establish that the resulting packaging can be used in contact with food. Regulation (EU) 2022/1616 adds a recycling-specific framework to the underlying EU food-contact rules. Its central distinctions concern the technology, the process or scheme, the installation and the resulting material’s intended use. [1]

This matters because “registered recycler”, “authorised process” and “recycled-content certificate” are not interchangeable descriptions. Each answers a different part of the evidence question.

Two technology routes, with conditions

Article 4 distinguishes a suitable recycling technology listed in Annex I from a novel technology developed under Chapter IV. For a suitable technology, the applicable route may require an authorised recycling process, as well as compliance with the relevant technology specifications and general requirements. For a novel technology, the regulation sets its own development and information conditions. [1]

The word “novel” therefore does not mean that ordinary safety obligations can be bypassed. Nor should a discussion of one established technology be extended to every polymer or recycling process. The actual input, decontamination route and applicable legal conditions must remain identified.

Follow the identity through the supply chain

The regulation’s Union register brings together different kinds of information about technologies, recyclers, installations, processes and schemes. A reader must identify the type of record being consulted. A registration number for one entity is not automatically an authorisation for a different process or an assurance covering every output made at the same site. [1]

The material supplied to the converter must also remain connected to the relevant documentation and restrictions. Article 29 and Annex III address declarations. Where a particular authorisation or technology specifies use conditions, removing those conditions from a downstream statement changes the meaning of the evidence.

Read the corrections with the original regulation

The original 2022 text is not the whole current record. Regulation (EU) 2025/351 amended parts of the framework. Regulation (EU) 2025/2269 subsequently corrected, among other provisions, the Article 4 cross-reference, labelling of delivered recycled plastic and responsibilities in the novel-technology development route. [2][3]

One important corrected distinction is that the initial detailed safety report in Article 10(4) is a developer responsibility. The corrections also clarify that labels on containers delivering recycled plastic describe that supplied plastic; they do not merely describe the transport container. These details affect how a reader follows information between actors.

A bounded conclusion for a finished package

The useful outcome is an evidence chain identifying the applicable recycling route, relevant process and installation, supplied material, declaration and intended food-contact use. A material’s recycled percentage can sit within that chain, but cannot replace it.

No individual recycler, process or packaging SKU is approved by this article. A specific finished-pack conclusion requires its actual records and the applicable current conditions, including the underlying plastics rules. Keeping these layers separate allows circularity claims to be examined without turning them into an unsupported food-safety claim. [4]
