Spain’s special tax on non-reusable plastic packaging is calculated on non-recycled plastic mass within products in scope. It is not simply a charge on the gross weight of a shipment, or on the entire mass of every pack that contains some plastic. Law 7/2022 separates the product scope, taxable activity, tax base and rate. [1]
The tax authority, AEAT, states the rate as EUR 0.45 per kilogram of non-recycled plastic in the products concerned. The useful first calculation therefore needs both a scope decision and a defensible material breakdown. [2]
Product and transaction are separate filters
Article 68 includes non-reusable packaging containing plastic and specified semi-finished products and closure, marketing or presentation components. A material’s plastic content alone is not the complete scope test. The article contains definitions and boundaries that must be read against the real item. [1]
Article 72 identifies taxable manufacture, import and intra-Community acquisition, alongside irregular introduction into the tax territory. Articles 69 and following establish the territorial and other framework. Who performs which transaction matters; a quotation from a converter does not establish the final tax treatment of every downstream movement.
| Question | Rule or evidence | Important boundary |
|---|---|---|
| Product scope | Non-reusable plastic-containing packaging and specified related products | Article 68; not a general tax on every plastic product |
| Taxable activity | Manufacture, import or intra-EU acquisition, as specified | Article 72; actor and transaction matter |
| Tax base | Kilograms of non-recycled plastic | Article 77; distinguish plastic mass from total pack mass |
| Rate | EUR 0.45 per kilogram of the tax base | Article 78; exemptions and other conditions remain separate |
Keep three masses apart
The whole pack’s mass, its plastic mass and its non-recycled plastic mass can be different numbers. Under Article 77, the relevant base is the non-recycled plastic quantity expressed in kilograms. Paper, metal or other non-plastic components are not turned into taxable plastic merely because they are part of a composite package. [1]
As an illustrative calculation, assume an in-scope, non-exempt quantity contains 100 kg of plastic, of which 30 kg is supported as recycled under the applicable evidence rules. The simplified base is 70 kg and 70 multiplied by EUR 0.45 gives EUR 31.50. This invented example illustrates arithmetic only; it does not determine a particular transaction’s liability, deductions or refund position.
Recycled content needs the specified evidence
Article 77(3) addresses certification of the recycled-plastic quantity, referring to UNE-EN 15343:2008 or replacement standards and the specified accreditation framework. It also addresses chemically recycled plastic. A voluntary marketing statement with an unexplained percentage should not silently take the place of that tax-evidence route. [1]
The standard reference is a legal evidence requirement for this purpose, not an assertion that this publication inspected the standard’s full proprietary clauses or certified a supplier. A usable file must connect the supported recycled quantity to the relevant product and reporting basis.
Exemptions do not change the basic denominator
Article 75 provides exemptions with conditions, including defined uses and transactions. An exemption needs its own evidence; it should not be inferred from a broad sales description such as “medical packaging”. The law also distinguishes subsequent deduction and refund mechanisms from the initial tax-base calculation. [1]
The defensible starting record is therefore compact but specific: the item, transaction, plastic mass, supported recycled quantity and any applicable relief basis. It explains the tax calculation without confusing recycled-content evidence with food-contact suitability or general environmental performance.
